Revised Form I-9
Effective April 3, 2009, employer must use a Revised Form I-9. Previous versions of Form I-9 will not be valid after that date.
The changes to the form include:
- No expired documents may be accepted as valid verification.
- A temporary I-551 printed notation on a machine-readable immigrant visa accompanied by a foreign passport has been added to List A acceptable documents. Also added to the List A acceptable documents is a passport from the Federated States of Micronesia (FSM) or the Republic of the Marshall Islands (RMI) with Form I-94 or Form I-94A indicating nonimmigrant admission under the Compact of Free Association Between the US and the FSM or RMI.
- Forms I-688, I-688A, and I-688B have been removed from the List A acceptable documents.
As a reminder, employers must verify that all new employees are eligible to work in the United State by obtaining a completed Form I-9 and reviewing the respective documents within three business days of the employee’s employment start date.

Federal Minimum Wage Increases to $7.25
The federal minimum wage rate increased to $7.25 per hour on July 24, 2009, as the third and final increase from the Fair Minimum Wage Act of 2007. A current federal minimum wage poster must be displayed by every employer in a conspicuous place. The poster is available free of charge on the DOL website. Please note that if a state has a minimum wage that is higher than the federal minimum, employers subject to the state minimum wage law are obligated to pay the higher rate to employees working in that state.

E-Verify Executive Order Delayed Until September 8, 2009
The effective date of Executive Order 12989 requiring federal contractors to verify the employment status of workers has been delayed until September 2009. Federal contractors with contracts awarded after September 8, 2009, and whose contract contains language regarding E-Verify, must use the system to verify the employment eligiblity status of both existing employees and new employees hired during the contract term.

2009 Mileage Reimbursement Rate Adjusted to 55 Cents
Effective January 1, 2009, the Internal Revenue Service (IRS) has adjusted the mileage reimbursement rate to 55 cents per mile for employment purposes. This is up from the previous 50.5 cents per mile that was in effect for January 1 through June 30, 2008 but lower than 58.5 cents per mile that was in effect from July 1, 2008 through December 31, 2008. The reimbursement for medical expense purposes is decreased from 27 cents per mile to 24 cents per mile.
